Case Study: A 10-Year Legal Battle Ends In A $24 Million Victory

In 1998, Michael’s client, a Youngstown asphalt contractor, entered into a contract with one of the largest gravel companies in the country to create a combined asphalt plant and supply yard. The asphalt contractor spent millions preparing for the joint venture. Without warning, the gravel company backed out. Michael’s client was financially ruined. After 30-plus years operating a profitable company, Michael’s client was out of business.

The Case Was Thrown Out Twice — But Michael Persisted

In 2004, the lawsuit was filed. After years of litigation, the case was thrown out by the trial court in 2010. Michael refused to give up, appealing the dismissal to the 6th U.S. Circuit Court of Appeals. The appellate court overturned the trial court’s decision and sent the case back down for a jury trial.

Trial And A Unanimous Verdict

In 2013, trial began. Michael was up against one of the largest law firms in the country. The result? A unanimous $15.6 million jury verdict in favor of Michael’s client.

Another Setback

The gravel company then hired the largest law firm in the country and asked the judge to set aside the jury’s verdict and throw the case out. The judge granted the request. But that was not enough to deter Michael. Michael and his team again appealed to the 6th U.S. Circuit Court of Appeals.

A Historic Win

In April 2016, the appeals court reinstated the original verdict and required the gravel company to pay prejudgment interest, bringing the total award to $24 million, one of the largest judgments in any Ohio court.
